1. Assignment Booking and Modifications
1.1 For each individual assignment, the terms specified in the specific recruitment agreement and these general terms and conditions for recruitment shall apply. In the event of any conflict, the order of precedence shall be as stated above.
1.2 Shaarp shall appoint a responsible recruitment consultant upon entering into the assignment. The name of the representative shall be specified in the written agreement.
1.3 If Shaarp’s representative ceases to work on the assignment (e.g., due to resignation, illness, or other reasons), Shaarp will appoint a new responsible consultant.
1.4 Unless otherwise agreed, prices are adjusted annually from January 1 in accordance with the Consumer Price Index (CPI) published by Statistics Norway.
2. Changes to Agreed Assignments
2.1 The client may propose changes to the assignment. Quantitative or time-related changes beyond what could reasonably have been expected at the time of agreement must be specifically approved.
2.2 Changes to the position and requirement profile must be agreed upon in writing in advance. Any changes made during the process are at the client’s own risk and responsibility.
2.3 The client may not cancel an assignment without written acceptance from Shaarp (see also section 5 regarding fees and payment terms).
3. Notices and Communications
All communications between the parties shall be in writing and sent to the contact person listed in the recruitment agreement.
4. Responsibilities
4.1 Shaarp shall carry out the assignment in accordance with documented methods and guidelines, and actively contribute to progress. The client shall be continuously informed of the status of the process.
4.2 Shaarp conducts the recruitment process in accordance with professional, certified methods but does not guarantee that qualified candidates will necessarily be identified in every individual process.
5. Fees and Payment Terms
5.1 A start-up fee is invoiced at the beginning of the project, as agreed in the recruitment agreement. The remaining fee is invoiced upon the signing of an agreement between the candidate and the client.
If the process is terminated after interviews have taken place, 70% of the agreed fee will be invoiced.
5.2 The start-up fee is non-refundable, even if the process does not result in the presentation of candidates.
5.3 If the client hires additional candidates from the same process within 6 months (including for other positions), the full fee will be invoiced for each individual hire.
5.4 Expenses related to advertising and publication shall be agreed separately.
5.5 Payment terms: net 14 days. Any invoicing fees will be charged according to applicable rates.
6. Rights and Confidentiality
6.1 All materials prepared by Shaarp are the property of Shaarp. Copying or reuse requires written consent.
6.2 Shaarp and its representatives are bound by a duty of confidentiality regarding all information about the client and their employees. This obligation remains in effect even after the assignment has been completed.
7. Use of Marketing Materials
Shaarp strives to use the client’s own marketing materials. When materials from Shaarp’s stock library are used, the license applies only to the specific assignment. Any reuse of such materials is at the client’s own risk.
8. Data Protection
The client and Shaarp are independent data controllers under the applicable data protection legislation.
CVs and other candidate data are the property of the candidate and may not be shared or forwarded without their consent.
9. Guarantee
If a hired candidate leaves within 6 months — unless due to resignation or lack of follow-up/training by the client — Shaarp offers a replacement recruitment at no additional fee. Direct expenses (e.g., advertising, travel, etc.) are to be covered by the client. The guarantee only applies to a completed process carried out by Shaarp.
